黑龍江省住房公積金提取管理暫行規定

第一章    

第一條  為加強住房公積金管理,規范住房公積金提取使用行為,根據國務院《住房公積金管理條例》(國務院令第350號)和有關法律法規,結合本省實際,制定本規定。

第二條  本規定所稱住房公積金提取是指住房公積金繳存人(以下簡稱繳存人)依照本規定,提取住房公積金賬戶內部分或全部存儲余額的行為。

第三條  本規定適用于黑龍江省行政區域內住房公積金的提取管理。

第四條  住房公積金管理中心(以下簡稱管理中心)負責繳存人住房公積金提取申請的受理和審批等管理工作。


第二章  提取范圍

第五條 繳存人有下列情形之一的,可以申請提取住房公積金賬戶內的存儲余額:

(一)購買、建造、翻建、大修自住住房的;

(二)償還購房貸款本息的;

(三)房租超出家庭工資收入規定比例的;

(四)退休的;

(五)出境定居的;

(七)完全喪失勞動能力,并與單位終止勞動關系的;

(八)與單位終止(解除)勞動關系,且非本行政區域戶口或戶口遷出本行政區域的;

(九)與單位終止(解除)勞動關系,滿兩年未再就業的。

第六條  繳存人符合本規定第五條(一)、(二)、(三)項情形提取住房公積金的,在本人賬戶存儲余額不足的情況下,可以同時提取配偶(共同還款人)的住房公積金,且合計提取金額不得超過實際發生額。

第七條  繳存人依照本規定第五條(四)、(五)、(六)、(七)、(八)、(九)項規定提取住房公積金的,同時注銷繳存人住房公積金賬戶。

第八條  繳存人符合提取條件但同時尚未還清個人住房公積金貸款的,繳存人及其配偶的住房公積金必須優先用于償還住房公積金貸款本息。

    第九條  繳存人購買的自住住房為多人共有的,共有人之間關系為同一戶籍的父母、子女、配偶的可以提取住房公積金。

 

第三章  提取額度

第十條  繳存人購買、建造、翻建、大修自住住房的,可辦理一次住房公積金提取業務,提取額度不得超過實際支出額。

第十一條  繳存人償還購房貸款本息提取住房公積金的,可以分次提取,累計提取額度不得超過貸款本息合計額。

第十二條  繳存人及其配偶因租賃住房房租超出家庭收入規定比例提取住房公積金的,提取額度不應大于實際支付的房租扣除超出家庭工資收入的比例,且不得超過房產部門公布的租房指導價格。房租超出家庭工資收入比例標準由管理中心按本地實際情況擬定,報住房公積金管理委員會(以下簡稱管委會)審核同意后實施。

第十三條  繳存人死亡或者被宣告死亡的,繳存人的合法繼承人或受遺贈人可以提取該繳存人住房公積金賬戶內的存儲余額;無繼承人也無受遺贈人的,該繳存人住房公積金賬戶內的存儲余額納入住房公積金的增值收益。

 

第四章  提取憑證

第十四條  本規定要求繳存人提供的有效證件或票據、文件,均指原件和復印件,管理中心對照審核后,原件退還申請人,復印件(掃描件)留管理中心存檔。

第十五條  繳存人申請提取住房公積金時,須提供本人身份證明。

第十六條  繳存人購買、建造、翻建、大修具有所有權的自住住房的,須提供下列證明材料:

(一)購買本行政區域內自住住房的,須提供經房產部門登記備案的商品房買賣合同、繳款票據或者房屋所有權證、契稅發票;

(二)購買納入本行政區域政府棚改拆遷項目住房的,需提供房屋拆遷補償協議、搬遷驗收單、繳款票據;

(三)異地購房的,須提供房屋所有權證、契稅發票及異地工作證明或異地戶籍證明;

(四)建造、翻建自住住房的,須提供《國有土地使用證》或《個人建房用地許可證》、《建設工程規劃許可證》、《建筑工程施工許可證》和購買建筑材料及施工費用支付憑證以及《房屋所有權證》;

集體土地上建造、翻建自住住房的,須提供《集體土地建設用地使用證》、《集體土地房屋所有權證》;

(五)大修具有所有權自住住房的,須提供土地、規劃、建設部門相關文件及購買建筑材料、施工費用發票、《房屋所有權證》。

第十七條  繳存人依照本規定第六條提取配偶的住房公積金的,須提供夫妻關系證明。

第十八條  繳存人償還住房公積金貸款本息的,原則按協議委托提取還貸方式辦理。

對于未開展協議委托提取還貸的管理中心,繳存人提取住房公積金償還貸款本息的,須提供近期還款證明和借款合同原件。繳存人償還自住住房商業貸款的,還須提供個人征信報告。并從首次歸還貸款之日起,根據繳存人償還貸款意愿,管理中心一年內至少為其辦理一次提取還貸業務。

第十九條  繳存人房租超出家庭工資收入規定比例提取住房公積金的,須提供本行政區域內房屋登記部門出具的本人及配偶無房證明、房屋租賃備案登記證明、三個月內的住房租金完稅證明、家庭工資收入證明。

繳存人承租本行政區域公共租賃住房提取住房公積金的,須提供由房屋租賃部門出具的租賃協議和租金支付憑據。

第二十條  繳存人退休的,須提供退休證或退休審批表。

第二十一條  繳存人出境定居的,須提供公安等相關部門簽發的移民批準文件或定居國(地區)長期居住證明。

第二十二條  繳存人死亡或被宣告死亡的,其合法繼承人(受遺贈人)須提供該繳存人的死亡證明以及合法繼承證明。

第二十三條  繳存人完全喪失勞動能力,并與單位終止勞動關系的,須提供與單位終止勞動關系證明及傷殘證(1-4級)或勞動能力鑒定機構出具的喪失勞動能力的證明材料。

第二十四條  繳存人調離本行政區域的,按異地轉移業務辦理。

第二十五條  繳存人與單位終止(解除)勞動關系,且非本行政區域戶口或戶口遷出本行政區域的,須提供與單位終止(解除)勞動關系的文件或協議、戶口證明或戶口遷移證明。

第二十六條  繳存人與單位終止(解除)勞動關系滿兩年未再就業的,須提供與單位終止(解除)勞動關系的證明及未再就業證明。

 

第五章  提取程序

第二十七條  繳存人辦理申請提取住房公積金的材料,所在單位應當予以核實,并出具加蓋單位印鑒的提取申請。

第二十八條  管理中心應當自受理申請之日起3個工作日內作出是否準予提取的決定,并通知申請人。

第二十九條  繳存人提取住房公積金可以委托本單位公積金專管員代理。由繳存人本人出具代理委托書,經所在單位審核蓋章,代理人應提供代理人及被代理人的身份證原件及復印件。

 

第六章    

第三十條  提取住房公積金時提供的證明材料不實或屬偽證,騙取本人或他人住房公積金的,由管理中心負責追回被騙取的住房公積金,并由相關部門追究直接責任人和所在單位領導的行政責任,情節嚴重構成犯罪的由司法機關依法追究刑事責任。

第三十一條  繳存單位、管理中心及受托銀行工作人員,不按本規定辦理提取造成工作失誤的,由所在單位責令限期改正,對負有責任的主管人員和直接責任人給予行政處分;玩忽職守、徇私舞弊造成損失的,追究其經濟責任;構成犯罪的,由司法機關依法追究刑事責任。

第三十二條  任何單位和個人不得限制符合提取條件的繳存人提取住房公積金。繳存人有權向省行政監督部門、管委會及管理中心檢舉揭發住房公積金提取中的違法違規行為。

 

第七章    

第三十三條  管理中心應依據本規定,結合實際制定住房公積金提取管理實施細則。

第三十四條  本規定自發布之日起三十日后施行.
